How Does Comparative Fault Affect an Injured Driver's Claim in Monroe, LA?.2608260805013.jpg)
An injured driver in Louisiana may still pursue damages even if some fault is assigned to them. Under Louisiana's modified comparative fault law, a person found to be 51% or more responsible cannot recover damages, while a person found less than 51% at fault can recover an amount reduced according to their percentage of fault.
When it comes to a head-on crash, investigators typically examine evidence that shows how the vehicles were positioned and how the other vehicle crossed the centerline to determine fault. This can include photographs, witness accounts, vehicle damage, roadway evidence, and available records that concern the circumstances of the collision.
Louisiana applies the modified 51% threshold, so even a partial-fault allegation can affect the value of an injury claim. Medical records that document the minor injuries and related treatment can help establish the nature and extent of the losses being claimed.
For accident victims, it is common that they find it hard to understand how the claim may develop alone. Many people seek legal guidance from a Monroe truck accident lawyer to have their evidence reviewed and have an assessment on whether another driver's actions account for most or all of the responsibility in their case.
