How Long Families Have to File a Wrongful Death Lawsuit in Weston, LA
In Weston, families have one year from the date of their loved one's death to file a wrongful death lawsuit. This deadline is set by Louisiana's statute of limitations for wrongful death claims.
So, what does this mean for surviving family members? To put it bluntly: missing this window can permanently bar them from pursuing legal action, regardless of how clear the circumstances of the crash may be.
Louisiana's one-year deadline is significantly shorter than what most other states allow. Many states give families two or more years to file. This makes it especially important for families in Weston to speak with an attorney as early as possible after losing a loved one in a fatal accident.
Who can file a wrongful death claim in Louisiana is also defined by law. The right to file belongs first to the surviving spouse and children of the deceased. If no spouse or children survive, the right passes to the parents of the victim. Siblings may file if no spouse, children, or parents survive.
Louisiana law establishes a clear order of priority, and understanding where a family member falls in that order matters when moving forward with a claim.
A wrongful death claim in Louisiana can seek compensation for a range of losses. These may include funeral and burial expenses, loss of the financial support the deceased provided, loss of love, companionship, and guidance, and the pain and suffering experienced by surviving family members.
The specific damages available depend on the relationship between the claimant and the deceased, as well as the facts surrounding the fatal crash.
Louisiana also follows a pure comparative fault system. This means that even if the deceased is found to share some degree of fault, surviving family members may still recover compensation. However, any award may be reduced in proportion to the percentage of fault assigned to the victim.
A wrongful death attorney can review the facts of a specific crash and explain how comparative fault may apply.
