Who Can File a Wrongful Death Claim in Waverly, LA?
In Waverly and throughout Louisiana, a wrongful death claim can be filed by the surviving spouse and children of the person who died. Either the spouse or the children may bring the claim.
If no spouse or child survives, the right passes to the parents. If no parent survives, siblings come next, followed by grandparents when no earlier family class is available.
Beyond the wrongful death claim, the same family members may bring a survival claim for losses the person experienced before death. These may include pain, medical bills, and other losses tied to the final injury.
Depending on the family’s losses, a wrongful death claim may seek compensation for loss of love and companionship, lost financial support, and funeral costs. Available damages depend on the relationship and circumstances involved.
Under Louisiana law, families generally have one year from the date of death or two years from the date of the injury to file a wrongful death claim, whichever period is longer.
Because Louisiana law limits who may file, a wrongful death lawyer can confirm which relatives qualify and in what order. An attorney can also review the circumstances surrounding the death and guide the family through the claims process.
