Who Can File a Wrongful Death Claim in West Carroll Parish, LA?

Louisiana law sets an order of eligible family members. The surviving spouse and children can bring a wrongful death claim first. If there are none, the parents may do so, followed by siblings, then grandparents. A separate survival action covers the person's own losses before death and passes to the same ordered group.

Timing is a second concern in these claims. Louisiana generally allows two years to file when the death occurred after July 1, 2024, while earlier deaths followed a shorter one-year period. The clock for a wrongful death claim typically runs from the date of death, and a survival claim has its own timing rules, so each date is worth confirming.

Recoverable losses may include funeral and medical expenses, lost financial support, and loss of love, affection, and companionship, depending on who qualifies. Birth certificates, marriage records, pay stubs, and funeral bills help establish both the family relationship and the financial loss.

Families commonly have to work out who qualifies while managing funeral arrangements, and a wrongful death lawyer can help confirm which relatives fit within Louisiana's ordered list and how the two claims fit together.
