Who Can Be at Fault When a Car Hits a Bicyclist in West Monroe, LA?
Fault depends on what each person did, and Louisiana uses pure comparative fault, so a bicyclist can still recover damages even if partly responsible, though the award is reduced by that share. Drivers must give bicyclists a safe passing distance, and bicyclists must follow traffic laws like other road users. Evidence decides how fault is divided.
Evidence in cases that involve bicycles usually looks different from other vehicle claims. Damage to the bicycle and the vehicle, a helmet, clothing, lighting and reflectors, and where each person was positioned in the lane can show how fault might be divided.
On busy roads, witness accounts and nearby camera footage can also matter, since drivers and bicyclists typically describe the same moments differently.
Timing is a concern as well. Louisiana generally allows two years to file a lawsuit for injuries from events after July 1, 2024, while older events were subject to a shorter one-year period. Medical bills, repair estimates, and photos should be kept, and a personal injury lawyer in Monroe can help preserve evidence, identify the insurers involved, and explain how comparative fault may affect a claim.
