Can You Still Recover Damages if You Share Fault in Bastrop, LA?
Louisiana follows a pure comparative fault rule, which means a person who shares blame can still recover damages, reduced by their own percentage of fault. For example, if a claimant is found 30 percent at fault, they would see a 30 percent reduction. Unlike many states, Louisiana does not bar recovery once a claimant passes 50 percent.
Fault percentages are assigned to every person who contributed, including those who are not named in a lawsuit. Insurers usually argue for a higher share against the claimant, because every point lowers what they may have to pay. That makes the evidence behind each percentage, such as photos, statements, and vehicle damage, central to how a claim is valued.
After a crash, many victims turn to a car accident lawyer to help them gather photos, witness statements, and records that speak to each driver's share of fault. A lawyer can also explain Louisiana's filing deadline, which is generally two years for recent injuries, though it is important to note that exceptions may apply.
