How Louisiana Law Applies to Pedestrian Deaths in Monroe, LA

Louisiana allows surviving family members, including a spouse, children, or parents, to pursue a wrongful death claim when a pedestrian dies from another party's negligence. These claims can address the financial impact of the loss, including lost support and loss of companionship. A separate survival action may also allow the estate to seek damages for any suffering the person experienced before death.

Louisiana follows a pure comparative fault system, which means fault can be divided between multiple parties without automatically barring a claim. Toxicology results and crash reconstruction findings tend to play a significant role in these cases in order to determine fault.

Louisiana generally allows one year from the date of death to file a wrongful death claim or two years from the date the underlying injury occurred. If a family doesn’t file the claim within that window of time, they can no longer recover any damages no matter how strong the claim is.

A Monroe wrongful death lawyer can help families understand what early steps to take and make sure that no filling deadline is missed.
