Why Uninsured Motorist Coverage Matters in Bastrop, LA Hit-and-Run Cases.2602041442150.jpg)
Louisiana law requires auto insurers to offer uninsured motorist coverage with every policy, though a policyholder can reject it in writing. When no rejection is on file, the coverage automatically applies at the same limits as the driver's liability coverage, which gives families a source of compensation even when the at-fault driver disappears.
This coverage becomes especially important in hit-and-run cases because a driver who flees the scene of a crash is legally treated the same as an uninsured driver under Louisiana law.
That means a person hurt by a driver who can't be identified, or the estate of someone killed in that kind of crash, may still be able to pursue a claim through their own uninsured motorist policy rather than depending on locating the responsible driver.
Filing this type of claim comes with its own challenges. Insurers usually conduct their own investigation before paying out, and details such as a prompt police report, witness accounts, and vehicle damage documentation can all affect how a claim is evaluated.
A wrongful death lawyer can help gather this information and communicate with the insurance company throughout that process.
